SCOPE – what is included and what is not included in our privacy policy
This privacy policy applies to all personal data/information that is collected and used by us when you complete the Contact Form on the Avenue Therapies website, when you call the Avenue Therapies telephone number, when you email Avenue Therapies, contact Avenue Therapies through our social media sites (Facebook, Instagram, LinkedIn etc) or other Avenue Therapies official communication routes.
For purposes of this privacy policy, ‘personal data’ means any information through which we can identify you, as further described below in ‘Personal Data We Collect’.
This policy does not include the data that is collected, stored, managed and disposed of by our associate therapists or associate service providers, including virtual assistants. We have additional policies including a Record Keeping and Data Protection Code of Conduct Policy and an Artificial Intelligence Usage Policy that we ask our associate therapists and associate providers to adhere to when they work alongside us. As independent associate therapists and associate providers they are responsible for their own practice and will adhere to their code of conduct and practice in line with their accrediting or registration organisation.
WHO WE ARE
Avenue Therapies Ltd is an organisation that supports qualified, experienced and trainee independent associate therapists to deliver psychological therapy and assessments to individuals who are experiencing mental health, emotional, psychological, personal and relational difficulties. We currently have associates who offer a mixture of face to face and online therapy. Avenue Therapies was founded on the belief that by providing a supportive community for associate therapists to practice and to be accountable to, that we would be able to offer high quality, evidence-based therapy for clients seeking private therapy.
Each associate is responsible for the data that you share with them. Avenue Therapies Ltd is responsible for the personal data you share with us as an organisation.
PERSONAL DATA WE COLLECT
The information we collect about you when you contact Avenue Therapies Ltd about our services may include the data listed below (jointly referred to as: ‘personal data’). We only collect and store data that you have shared with us. You can request for us to delete this information at any time and within reason and where there is no conflict / professional / ethical / legal requirements to not do this (for example, conflict with legal proceedings etc), we will do so.
If you do not consent to Avenue Therapies Ltd having this personal data, then we will not be able to continue with assessment or treatment. The following lists give examples of personal data we may receive and store but is not limited to:
- Your contact details: Your name, postal address and other contact details, such as your telephone number and e-mail address. This is for the purposes of being able to respond to, or maintain contact with you.
- Your reviews: The opinions, experiences, preferences and interests, and product or event reviews that you publish on our website, google reviews or share with us online or through social media, such as your experiences and tips regarding engaging with Avenue Therapies Ltd or with therapy.
- Your communication data: Your requests, any complaints you may have and any other data that we receive if we communicate with you via e-mail, online or via social media.
- Your personal information: For example, your date of birth, gender, GP / healthcare details, occupation, next of kin, medical history, information about your present situation or difficulties or risk information.
WHAT WE DO WITH YOUR PERSONAL DATA
Avenue Therapies Ltd collects and uses your personal data for the purposes set out below. Please be informed that insofar as Avenue Therapies Ltd already holds information about you, Avenue Therapies Ltd may use that information for the same purposes.
To receive and process your enquiry regarding our services:
In order to manage your enquiries (online and by telephone) and to provide you with the services you request from us in accessing therapy or assessment, we use your contact details to start and maintain communication with you until the point where you request for your details to be deleted or destroyed, or for the length of time stipulated by GDPR.
Sharing your contact data with the Associate Therapists who work with us:
When you have decided you would like to proceed with therapy / assessment, your contact details are shared with the identified associate for the purposes of arranging an appointment. Once you meet with the associate, you will agree with your therapist any further information you wish to share. This sharing of information is not the responsibility of Avenue Therapies Ltd and will be a separate agreement between you and the associate therapist. From this point, the associate is responsible for how your data is stored, managed and deleted and includes any use of Artificial Intelligence (AI). We have recommended to our associates to use a Consent Form to outline and formalise this agreement. If you have any queries or concerns around this, please raise this with the associate in the first instance.
To comply with a legal obligation to which Avenue Therapies is subject:
Any information referred to above in the section ‘Personal Data We Collect’ may be used to maintain appropriate business records, to comply with lawful requests by public authorities and to comply with applicable laws and regulations or as otherwise required by law.
For our legitimate commercial interests:
We currently do not use your contact details for general marketing purposes, surveys or feedback. We do not use other third party sources to collect data.
Use of information based on your consent:
We will only use your information for contacting you, for providing services requested by you and for recording comments/reviews etc on social media for as long as you are happy for us to do so. You can withdraw your consent for us to hold your contact information at any time within the limitations of our legal obligations (as stated above).
How do we store this information?
Avenue Therapies Ltd, associates and associate providers (including virtual assistants) are required to use secure data storage which is compliant with GDPR (General Data Protection Regulation). Associates may also keep paper notes from sessions. These will be stored securely in line with GDPR regulations. Avenue Therapies Ltd and all associates are expected to be registered with the Information Commissioners Office (ICO). The ICO is an independent regulatory body for data protection and dealing with the Data Protection Act 2018 and reports directly to Parliament in the UK.
HOW WE SHARE YOUR DATA
We may share your personal data with the following parties:
- Our associate providers: We work with administrative support who provide Avenue Therapies Ltd with telephone and email management and administrative services.
- Our associates: Where you have requested that your contact information be shared for the purposes of accessing the services you want.
- Our Associates will always share with your GP that they are working with you. The level of detail which is shared is something that can be negotiated with the associate directly.
- In exceptional circumstances, if we are concerned about your safety and wellbeing or the safety and wellbeing of others, we would share your information with legally appropriate persons or organisations e.g. Police or your GP for the purposes of keeping you and others safe.
- Third parties in case of legal requirement. We may also disclose your personal data if we believe we are required to do so by law. We may also do this where doing so is reasonably necessary to comply with legal processes; when we believe necessary or appropriate to disclose personal data to law enforcement authorities, such as to investigate actual or suspected fraud or violations of law, breaches of security, or breaches of this Privacy Policy; to respond to any claims against us; and, to protect the rights, property, or personal safety of Avenue Therapies Ltd or our associates, customers, or the public.
- Please be aware that at times Avenue Therapies Ltd and the associates may ask to email documents to you. The email system that Avenue Therapies Ltd use is secure, however, once the email leaves our server the data may longer be secure depending the security of your server.
USE OF ARTIFICIAL INTELLIGENCE (AI) TOOLS
Avenue Therapies Ltd will not share any personal or sensitive data with any AI tools. On occasion AI tools may be used to generate information, resources or booking systems. AI tools used will be complaint with professional codes of conduct, in line with NICE Guidance and GDPR complaint. Associates and partners of Avenue Therapies Ltd are instructed to declare any use of AI Tools in their work with you prior to starting therapy or assessments. They are instructed to use tools that are GDPR complaint and to follow Avenue Therapies Ltd policy on AI usage. Avenue Therapies Ltd is not liable for associates, or partners’ use of AI tools in their work.
COOKIES, ANALYTICS AND PERSONALISATION
We currently use cookies, JavaScript, local storage, log files and other mechanisms to automatically collect and record information about your browsing activities and use of the Services.
SOCIAL MEDIA
When you participate in various social media forums like Facebook, Twitter, Instagram, LinkedIn, etc., you should be familiar with and understand the tools provided by those sites that allow you to make choices about how you share the personal data in your social media profile(s).
